1. Introduction

Welcome to GSM Tennis Academy (“we”, “us”, “our”). We operate as an online platform connecting independent tennis coaches (“Coaches”) with players (“Players”) who wish to book tennis lessons in the United Kingdom. By accessing or using our website, creating an account, or booking a lesson, you agree to these Terms and Conditions. If you do not agree with any part of these terms, please do not use our platform.

2. Our Role

GSM Tennis Academy operates solely as an introducer and booking platform. We do not provide tennis coaching services ourselves. Each coach listed on our website is self-employed and is entirely responsible for delivering their own coaching sessions. When a Player books a lesson through our platform, a contract for coaching services is formed directly between the Player and the Coach.

GSM Tennis Academy acts only as an intermediary to facilitate the booking, scheduling, and payment process. We collect payment from the Player on behalf of the Coach, and after the lesson is completed, we transfer the coaching fee to the Coach minus a small finder’s fee retained by GSM Tennis Academy. This finder’s fee represents our only income for VAT purposes.

3. Payment Handling

All payments made by Players are received by GSM Tennis Academy as agent for the Coach. Funds (excluding our finder’s fee) are held on trust for the Coach until they are released after successful completion of the booked lesson. Payment processing is handled through secure third-party payment providers. By making a payment, you agree to the applicable terms and conditions of those providers.

4. Pricing and Finder’s Fees

Coaches set their own hourly rates for lessons. GSM Tennis Academy adds a small finder’s fee to each booking to cover our service and administrative costs. This fee is included in the advertised rate shown on our website. For example, if a Coach charges £50 per hour, the advertised price may be £55 per hour, with the £5 difference representing our finder’s fee.

5. Cancellations and Refunds

5.1 Cancellations by Players

Players may cancel or reschedule lessons in accordance with the cancellation policy stated at the time of booking. If a Player cancels within the permitted time frame, any refund due will be processed by GSM Tennis Academy on behalf of the Coach. Finder’s fees retained by GSM Tennis Academy in connection with completed or late-cancelled bookings are non-refundable.

5.2 Cancellations by Coaches

If a Coach cancels a booked lesson, GSM Tennis Academy will notify the Player and arrange for a full refund or reschedule at the Player’s discretion.

5.3 Disputes and Refunds

GSM Tennis Academy assists in resolving disputes between Players and Coaches but does not assume responsibility for the quality or outcome of coaching sessions. Any refund or compensation beyond the original booking amount is at the discretion of the Coach.

5.4 Non-Attendance

If a Player fails to attend a booked lesson without giving prior notice, the session fee may be forfeited according to the Coach’s cancellation policy.

6. Relationship Between GSM Tennis Academy and Coaches

All Coaches using the platform acknowledge that GSM Tennis Academy:

• Acts only as an introducer and facilitator of bookings;
• Does not employ Coaches or provide coaching services;
• Is not a party to any contract for coaching sessions between Coaches and Players.

Coaches remain fully responsible for:

• Their own professional conduct and coaching standards;
• Maintaining appropriate qualifications and insurance;
• Paying their own taxes and complying with applicable laws.

GSM Tennis Academy will deduct the agreed finder’s fee from each payment received and remit the balance to the Coach once the relevant session is completed.

7. Limitation of Liability

GSM Tennis Academy is not liable for any loss, injury, or damage arising from coaching sessions, cancellations, or rescheduling. Our responsibility is limited to facilitating bookings and payments between Coaches and Players. Nothing in these Terms excludes or limits liability where such exclusion would be unlawful under UK law.

8. Changes to These Terms

We may update these Terms and Conditions from time to time. Any changes will take effect upon posting on our website. Your continued use of our services after such updates constitutes your acceptance of the revised terms.

9. Governing Law

These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of England and Wales.
